Immigrant Legal Resource Center Red Cards

All people in the United States, regardless of immigration status, have certain rights and protections under the U.S. Constitution. The ILRC’s Red Cards help people assert their rights and defend themselves in many situations, such as when ICE agents go to a home.

What to do if ICE shows up at your home / Qué hacer si ICE aparece en tu casa

Keep calm! 

You have constitutional rights.

  1. DO NOT OPEN THE DOOR. No one can enter your home without your consent: “I will not open the door if I do not have a court order signed by a judge or magistrate.”

  2. If ICE enters your home, say: “I DO NOT consent to the search.”

  3. Exercise your right to remain silent! “I will not answer any questions and I exercise my right to remain silent.”

  4. DO NOT SIGN ANY DOCUMENTS: “I will not sign any documents without first speaking to my lawyer.”

  5. Keep calm and it is better to remain silent (any incorrect information can harm you)

If officers come to my house, how do I know they are from ICE?

ICE agents will often pretend to be police officers and say they want to talk to you about an issue such as identity theft or a case they are investigating. If they say “WE ARE THE POLICE,” ask them to slide your card or warrant under the door or show it through the window.

Do I have to let ICE or the police into my house?

You do NOT have to let ICE or the police in unless they have a warrant signed by a judge authorizing them to enter and arrest someone in your home. You must ask them to slide the warrant under the door before opening it. In the vast majority of cases, ICE will not have a warrant and would need YOUR consent to enter your home. Opening the door does not mean you are giving your consent.

Esto es su hogar. Tienes Derechos Consitucionales 

  1. NO ABRAS LA PUERTA. Nadie puede entrar a su hogar sin tu consentimiento: “no voy abrir la puerta si no tiene orden judicial firmada por un juez o magistrado.” 

  2. Si ICE entre a tu hogar, diga: NO consiento el allanamiento.

  3. ¡Ejerce tu derecho a mantenerte en silencio! “No voy a contestar ninguna pregunta y ejerzo mi derecho a mantenerme en silencio.

  4. NO FIRME NINGUN DOCUMENTO: “No voy a firmar ningún documento sin antes  hablar con mi abogado.”

  5.  manten la calma y es mejor quedarse en silencio (cualquier información incorrecta te puede perjudicar) 


¿Si los oficiales vienen a mi casa, como me doy cuenta que son de ICE?

Los agentes de ICE en varias ocasiones fingen ser policías y dicen que quieren hablar con usted sobre un tema como el robo de identidad o sobre un caso que estan investigando. Si ellos dicen “SOMOS LA POLICIA” Pidales que pasan su tarjeta u orden por de debajo la puerte o que lo muestran por la ventana. 

¿Tengo que dejar entrar ICE o la Policia en mi Casa?

NO tiene que dejar entrar a ICE ni a la Policía a menos que tengan un orden firmado por un juez que les autoriza a ellos ingresar para arrestar a alguien en su hogar. Usted tiene que pídeles que pasan la orden por debajo de la puerta antes de abrirla. En la gran mayoría de los casos, ICE no tendrá una orden judicial y necesitaría SU consentimiento para ingresar a su hogar. Abrir la puerta no significa que está dando su consentimiento.
